Users of this software must categorize themselves in exactly one of the three categories listed below.

NON-COMMERCIAL USE: "Non-Commercial Use" means use of the Software for noncommercial purposes only, and is limited to the following users: non-profit organizations (charities and other organizations created for the promotion of social welfare), universities, colleges and other educational institutions (including, but not limited to elementary schools, middle schools, high schools, and community colleges), independent contractors who are under contract by the above-stated organizations, and other individual users who use the Software for personal, non-commercial use only (for example, hobby projects). Under no circumstances can the Software be used to generate income for personal benefit. CodeFX reserves the right to further clarify the terms of Non-Commercial Use at its sole determination.

Linux4.TV SET-TOP BOX USAGE: If the Software is to be used for development on the Linux4.TV set-top box (National Geode CPU) you are allowed to evaluate the Software and to do exploratory development and "proof of concept" prototyping on the Linux4.TV target device whether at home for personal use or at work as a prototyping tool. However, if you or your employer get serious about developing a commercial version of such items, and you want to continue basing your development on the Software, then you will need a commercial development license.

ALL OTHER USE: If your usage of the software cannot be classified as "Non-Commercial Use" or "Linux4.TV SET-TOP BOX USAGE" you are only allowed to download and view the Software. You may not compile, link, run, or utilize the software in any manner except for viewing. Under no circumstances can the Software be used directly or indirectly to generate income of any kind.

If your use of the software is categorized as either "NON-COMMERCIAL USE" or "Linux4.TV SET-TOP BOX USAGE" or "ALL OTHER USE" and you agree to the conditions set forth in the above corresponding paragraph as well as the additional terms and conditions specified below, CodeFX hereby grants to the user a limited, revocable, non-exclusive, non-transferable license to use the Software.

COPYING: The Software may be copied as long as this license (in unmodified form) remains with the Software. New users of the Software must be made aware of this license and agree to it before usage of any kind commences.

TITLE: Title and ownership rights to the Software remain with CodeFX. The Software is owned and copyrighted by CodeFX and the user is only granted limited rights to use the Software.

MODIFICATIONS: If the usage of the Software is categorized above as either "NON-COMMERCIAL USE" or "Linux4.TV SET-TOP BOX USAGE" the user is allowed to make modifications to the Software. CodeFX strongly encourages any designer(s) of such modifications to contact CodeFX and detail the changes that have been proposed or implemented in order to keep the Software up to date and bug free.

THE SOFTWARE IS PROVIDED "AS IS" WITH NO WARRANTY OF ANY KIND, INCLUDING THE WARRANTY OF DESIGN, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALTHOUGH THIS SOFTWARE HAS BEEN TESTED, IT IS VERY LIKELY THAT DEFECTS EXIST IN THE SOFTWARE (BUGS). THESE DEFECTS COULD CAUSE SYSTEM LOCKUPS, INCORRECT EXECUTION, SECURITY BREACHES, SYSTEM REBOOTS, ETC. YOU HAVE BEEN WARNED AND CODEFX WILL NOT BE HELD RESPONSIBLE FOR ANY PROBLEMS OR THEIR RAMIFICATIONS.

USE OF THE SOFTWARE FOR HIGH RISK ACTIVITIES IS EXPRESSLY PROHIBITED. THIS INCLUDES (BUT IS NOT LIMITED TO) AIRTRAFFIC CONTROL, LIFE-SUPPORT SYSTEMS, WEAPONS SYSTEMS -- ANY SYSTEMS WHICH MAY CAUSE SERIOUS HARM TO PEOPLE OR FINANCES.
